What is Psychic Science? In the United States, it is a relatively new belief that has been gaining some popularity over the last twenty years or so. It is the belief of psychic science and various scientific organizations that all forms of psychic phenomena are due to psychic energy traveling through various channels in and around the physical world. These different channels include sight, touch, and thought, although not all of these can be measured using scientific means.
Some groups have been formed in order to bring attention to this topic. The United States Psychic Association is one such organization, which has helped to put the issue on the political radar. This same principle applies to people’s right to practice free speech as they see fit. The first amendment protects their right to speak and express their opinions on all topics. In this instance, the client must be able to prove to the reader of their problem that s/he is a real person and not just reading off a piece of paper or some other kind of easily reproducible recording device.
The second amendment, the right to bear arms, and the third amendment, the right to keep and bear arms are also at issue in this controversy. The first amendment protects the speech of all American citizens, which includes those practicing psychics and/or fortune tellers. The second amendment guarantees a right to bear arms for self defense, which includes people using a gun to protect themselves from another person. The third amendment protects the citizens of California from being deprived of their rights in any way, such as by being arbitrarily deprived of their right to vote.
Proponents of the overbroad regulation feel that the majority of California residents who voted in favor of the ordinance are simply trying to have their voices heard above others. Opponents argue that the ordinance is an overbroad restriction of speech and California law, as interpreted by the courts, has recognized a right to expressive activity beyond the freedom of speech established in the first amendment. They argue that the majority of those voting in favor of the ordinance do not actually understand the full extent of protected speech and thus are not motivated to protect it beyond their constitutional rights. The court likely will issue an overbroad decision in this case and the debate will proceed.
